These Terms are an agreement between you and LLC Kreyol Kollection, a New York limited liability company (“we,” “us,” or “our”), which owns and operates the BrokeLess app (“BrokeLess” or the “App”). By creating an account or using BrokeLess, you agree to these Terms and our Privacy Policy. If you don’t agree, please don’t use the App.

1. Who can use BrokeLess

You must be at least 18 years old and able to enter a binding agreement. You’re responsible for keeping your password safe and for all activity on your account.

2. What BrokeLess does

BrokeLess helps you plan and track your money. It shows what’s yours to spend, plans bills across paychecks, tracks Pay Later plans and subscriptions, helps you decide if you can afford something, and helps you set and stick to savings and debt goals. It includes features like Lock-In Mode and our in-app assistant, Pennii.

3. What BrokeLess does not do

• BrokeLess does not hold, move, transfer, or invest your money. Any money you move, you move yourself through your own bank or provider.
• BrokeLess is not a bank, lender, credit counselor, or financial, investment, tax, or legal advisor. Nothing in the App, including anything Pennii says, is professional advice. For advice about your situation, talk to a qualified professional.
• Lock-In Mode is a planning and motivation feature. It does not lock or restrict any real bank account or money.

4. Accuracy of information

BrokeLess’s numbers and suggestions depend on the information you enter or confirm. Information read from screenshots is created automatically and may contain mistakes. Always review it before you confirm it, and check important numbers with your bank or provider. We are not responsible for decisions made based on incorrect or incomplete information.

5. Your content

You own the information you add to BrokeLess. You give us permission to use it only to run and improve the App for you, as described in our Privacy Policy. Only upload screenshots and statements that belong to you or that you have permission to share.

6. Acceptable use

You agree not to use BrokeLess for anything illegal or fraudulent; upload someone else’s financial information without permission; try to hack, overload, reverse-engineer, or disrupt the App; access other people’s accounts or data; or use the App to build a competing product. We may suspend or close accounts that break these rules.

7. Fees

BrokeLess is currently free while in testing. If we offer paid features later, such as BrokeLess Plus, we’ll clearly show the price before you’re charged. Purchases through the Apple App Store or Google Play also follow their terms.

8. Our intellectual property

The BrokeLess name, logo, the Pennii character, designs, and software belong to LLC Kreyol Kollection and are protected by law. You may not copy or use them without our written permission.

9. Changes and availability

We may update, change, or stop parts of the App at any time and will try to give notice of major changes. We may update these Terms; if the changes are important, we’ll tell you. Using the App after changes means you accept them.

10. Ending your account

You can delete your account anytime in Profile → Delete my account. We may suspend or end your access if you break these Terms. Sections 3, 4, 8, 11, 12, 13, and 14 still apply after your account ends.

11. Disclaimer of warranties

BROKELESS IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE ANY FINANCIAL RESULT, SAVINGS AMOUNT, OR DEBT OUTCOME.

12. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, LLC KREYOL KOLLECTION AND ITS OWNERS, MEMBERS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF MONEY, PROFITS, OR DATA, ARISING FROM YOUR USE OF BROKELESS, INCLUDING LATE FEES, OVERDRAFT FEES, MISSED PAYMENTS, AND FINANCIAL DECISIONS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $50.

Some places don’t allow these limits, so they may not fully apply to you.

13. Indemnity

You agree to defend and hold harmless LLC Kreyol Kollection from claims arising from your violation of these Terms or misuse of the App.

14. Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Kings County, New York, unless the law requires otherwise.

15. Apple and Google

If you downloaded BrokeLess from the Apple App Store or Google Play, those companies are not parties to these Terms and are not responsible for the App. They are third-party beneficiaries of these Terms only as required by their developer rules.
